PLATFORM TERMS
Terms of Service
1. Agreement and scope
These Terms govern access to and use of HALO Finance, a business finance and operations platform operated by Created By Halo (“HALO”, “we”, “us”). By creating, activating or using a workspace, the customer and authorised users agree to these Terms and the documents incorporated by reference.
HALO Finance is designed to help service businesses organise clients, quotes, invoices, payments, income, expenses, budgets, savings goals and reserve movements, cash flow, operations and related records. It is not a registered accounting, tax, legal, investment or financial-advisory service.
2. Customer responsibilities
- You must provide accurate account and business information and keep it current.
- You are responsible for deciding what data is entered into your workspace and for having a lawful basis to process personal information you upload.
- You remain responsible for verifying invoices, VAT/tax treatment, accounting classifications, statutory submissions and financial records.
- Login credentials are personal and must not be shared. You must promptly report suspected unauthorised access.
3. Data ownership and processing
As between HALO and the customer, the customer retains control of business data entered into its workspace. Where HALO processes personal information contained in that data on the customer's instructions, HALO acts as an operator for POPIA purposes, subject to the Data Processing Addendum. HALO acts as a responsible party for information it determines the purpose and means of processing, such as account administration, support, security and platform billing information.
4. Acceptable use
You may not use the service to break the law, infringe rights, store malicious code, attempt to access another tenant, probe or bypass security controls, abuse infrastructure, or process information you are not entitled to process. Automated scraping, credential sharing and attempts to reverse engineer security controls are prohibited.
5. Early access and changes
Where a workspace is designated Early Access or Trial, features may be changed, improved, limited or withdrawn while the product is being evaluated. We will take reasonable steps to protect stored data and continuity, but Early Access is not represented as an uninterrupted or error-free production service.
6. Availability, backups and customer copies
We use reasonable technical and organisational measures to operate the service. Planned maintenance, hosting failures, internet failures and events outside reasonable control can affect availability. Customers should retain copies of records that are critical to statutory, tax or business continuity obligations. HALO's operational backup status is maintained as part of its internal compliance programme and must not be interpreted as a substitute for a customer's own statutory recordkeeping obligations.
7. Suspension and termination
We may suspend access where reasonably necessary for security, legal compliance, non-payment, misuse or protection of other tenants. On termination, data export or deletion will be handled in accordance with the Privacy Notice, Data Processing Addendum and applicable retention requirements. Records that must legally be retained may be restricted rather than immediately deleted.
8. Intellectual property
HALO Finance, its interface, software, branding and platform materials remain the property of HALO or its licensors. Customers retain rights in content and business data they provide.
9. Warranties and liability
Nothing in these Terms excludes rights or remedies that may not lawfully be excluded under South African law, including the Consumer Protection Act where applicable. Subject to those rights, HALO is not responsible for business decisions made solely from unverified data, tax/accounting treatment selected by a user, third-party service failures, or losses caused by credentials or data supplied by the customer contrary to these Terms.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa. The parties should first attempt to resolve disputes in good faith before commencing formal proceedings, without limiting any statutory complaint or consumer right.
